I would like to assume that states don't do unconstitutional things, that my government always does the legal thing, that all new laws are well reasoned from a legal basis, but . . .history. Too many examples of individuals in gubment doing things or even openly saying "who cares, try to stop me, or we think we are right-and the 9th Circuit got this one wrong."
Force makes right (even when it is wrong). So . . .I presume that anytime any government entity (the force part) attempts to regulate, curb freedoms, etc, that the force must face some level of scrutiny--and that is where the differences / opinions come out.
I, too, am interested in watching this enforcement play out, and as someone else in this thread said, one side is likely to win, and one side is likely to lose--and rarely is it as clear-cut or as quick as one side wants it to be. . .
