help, police deuche bag problem

so i had just pulled out of mcdonalds and some cop is sitting at this bank nextdoor and gives me the weirdest look. Sure enough he pulls out to follow me but doesn't pull me over right away. Then he pulls me over. Says i was going 49 in a 30. So i ask him to see the radar, but he wont show me it. Tells me its teenagers hotshot kids like me that drive bimmers that think they know the law. (ps i'm 16). Then he makes me do a bunch of alchohol tests. Ha yeah, drinking on a wensday night right after school is out. So i'm looking for some help. By law does he have to show me the radar? i live in illinois

Were you doing 49 in a 30? I'm not sure about Illinois law, but here in MA they are not obligated to show you the radar readout. You didn't mention whether you received a ticket, but I assume you did. I'd recommend going the lawyer route as I would imagine that being a new driver with a speeding ticket will dramatically increase your insurance rates. It'll probably be cheaper than having to pay the higher premium.

Did you get a ticket? If not dont worry about it cops dont have to show you crap until you go to court. Thats what the discovery stage is for..

I had just reached the speed limit when he saw me. Also he told me using his radar he got me at 49, and now looking at the ticket, it says he didn't use a radar

So under how they determined your speed what does it say? Did he pace you or get you visually?

I would fight the ticket....get a lawyer if possible and let him know everything that was spoken....seems like the cop was harassing you

how did he estimate your speed? In Ohio, if they pace they have to round down to the nearest 5mph. My father-in-law is a retired state trooper here, and according to him, it's thrown out if not done that way. Same goes for estimating. Don't try to fight the method of estimating, almost every court in the country has taken judicial notice that a police officer has specific training and is able to do this with a high degree of accuracy. You'd have to fight his vantage point and other circumstances of the stop, like ambient light (day, dusk, night, dawn), weather, traffic, etc.

I've asked about this too, father in law couldn't think of a single place in the country that required the cop to show the radar. It's an urban myth.

I think without a lawyer in general, he wouldn't have a chance....a traffic lawyer will know all this stuff

oh and what i forgot to say, was that i was approaching a stop sign also so i was just starting to slow down to, so i was probably under the speed limit lol. i was sitting at the stop sign when he finally pulled out, if that makes any difference

no, ive gotten pulled over stopped 5 blocks down the road because of a sign that says "Your Speed: XX"

well, yeah. If you've never been to court, get a lawyer. I'm 3 for 5 w/o a lawyer, 1/1 with! Got railroaded once on my own, lawyer would have helped, and the other, well, I was guilty as hell!
