As a max fan I do think that's a penalty regardless of who does that. Even if it was from understeer from going in too hot.

If HAM crossed back at VER he could have gained a place, because then only MAX was off track.

Now no investigation needed as both were off track.

But with 17 laps to go I'm sure HAM will get more opportunities to launch his attack.
